Texas Attorney General Ken Paxton has filed a lawsuit against Dr. Megan Carpenter, a physician based in New York, alleging that she unlawfully prescribed and mailed abortion pills to a woman in Texas, infringing state regulations.
A case has been filed in Collin County, Texas, representing the first major challenge to abortion shield laws intended to safeguard providers in states where abortion is still legal.
Shield laws, like those implemented in New York, prevent state collaboration with inquiries or legal actions concerning abortion services offered to individuals from states with restrictive policies. Seven additional states have enacted comparable laws, which may lead to extended legal disputes.
“This was inevitable,” remarked Mary Ziegler, a legal scholar, highlighting the wider consequences of conflicts between states regarding abortion rights.The lawsuit aims to impose significant penalties and prevent Carpenter from engaging in telemedicine in Texas, heightening conflicts between states with differing abortion policies.
New York Attorney General Letitia James responded, emphasizing her state’s dedication to protecting abortion providers from “unjust attempts to punish them.”
