Texas Lawmaker Introduces Bill to Govern AI Use and Protect Data

State Rep. Giovanni Capriglione (R-Southlake) has introduced House Bill 1709, which aims to establish a thorough regulatory framework for artificial intelligence (AI) in Texas. The Texas Responsible Artificial Intelligence Governance Act (TRAIGA) establishes guidelines aimed at fostering ethical development, safeguarding data, and mitigating AI bias, all while encouraging education and innovation within the state's AI industry.

The bill includes key proposals such as mandating companies to disclose their use of AI, improving protections for personal data, promoting education tailored to the AI-driven economy, and creating guidelines to prevent bias and misuse. “If AI is allowed to operate without constraints, it inevitably develops biases,” stated Matt Rosen, CEO of the technology company Allata.

TRAIGA also introduces the "Artificial Intelligence Regulatory Sandbox Program," which provides temporary regulatory exemptions for companies testing new AI technologies, fostering innovation while ensuring oversight.

The bill also highlights the importance of safeguarding against censorship by mandating transparency and accountability in AI content moderation systems. Capriglione characterized the proposal as a partnership with industry leaders and scholars, with the goal of positioning Texas as a benchmark for responsible AI governance.

Rosen emphasized that, in the context of limited federal regulation, state initiatives such as TRAIGA play a vital role. Still, they need to maintain a "cautious balance" between promoting innovation and guaranteeing ethical use. “Understanding AI, embracing it, and addressing both its positives and negatives is the better approach,” he stated.

HB 1709 has the potential to establish Texas as a frontrunner in defining the future of AI policy and governance.
