House Committee Subpoenas Death Row Inmate in Last-Minute Attempt to Delay Execution

On Wednesday, a Texas House committee made a remarkable decision, voting unanimously to issue a subpoena for death row inmate Robert Roberson. The decision was made merely a day prior to his planned execution, representing a final attempt to stop his sentence following several court denials.

Roberson is poised to be the first individual in the U.S. to face execution for the alleged act of shaking a baby to death.The committee is spearheaded by state Reps. Brian Harrison and Jeff Leach . It aims to require Roberson to deliver testimony and information in relation to their ongoing investigation.

Benjamin Wolff, director of the Texas Office of Capital and Forensic Writs, states that this legal maneuver is without precedent. "It creates a potential separation of powers dilemma that may hinder his execution scheduled for tomorrow night," Wolff noted, adding that he had never encountered this strategy employed in similar situations before.

Roberson’s request for clemency was denied on Wednesday, resulting in his execution being set for Thursday. The subpoena seems to be a final attempt by lawmakers who have voiced worries regarding the equity of the case.

Gretchen Sween, Roberson's attorney, expressed a similar viewpoint, remarking, "It highlights the intensity of the lawmakers' feelings regarding the injustice they see in this case." The committee's action introduces an additional layer of complexity to Roberson’s case, underscoring the legal and ethical discussions surrounding the death penalty and judicial process in Texas.
